Terms of Service — AdVizion

These Terms of Service (“Terms”) govern your access to and use of the AdVizion platform (“Service”) provided by AdVizion AI, Inc. (“AdVizion”, “we”, “us”). By accessing the Service you agree to be bound by these Terms.

1. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You must not:

Upload content that infringes third-party intellectual property rights.
Use the Service to create, distribute, or promote illegal, deceptive, or harmful content.
Attempt to reverse-engineer, copy, or resell the underlying models or platform infrastructure.
Use automated scripts, bots, or bulk-upload pipelines without an active API agreement with AdVizion.

2. Accounts and Credentials

You are responsible for maintaining the confidentiality of your login credentials and API keys. You must notify us immediately at security@advizion.net if you suspect unauthorised access to your account.

3. Credits and Payments

The Service operates on a credit model. Credits are consumed per analysis or generation action. Failed requests are never charged. Credits are non-refundable except where required by applicable law. All payments are processed by Stripe. Subscription fees are billed in advance and are non-refundable.

4. Intellectual Property

You retain ownership of all content you upload to the Service. You grant AdVizion a limited, non-exclusive licence to process your content solely for the purpose of providing the Service. We do not use your content to train our own models.

AdVizion and its licensors own all rights in the platform, including software, AI models, and documentation. Nothing in these Terms transfers any intellectual property rights to you.

5. AI-Generated Content

The Service uses third-party AI providers (Google Gemini, Veo, Qwen) to generate analysis reports, coach recommendations, images, and video. AI outputs may contain inaccuracies. You are solely responsible for evaluating and using AI-generated content, and for any advertising decisions made on its basis.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms.

7. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. AdVizion does not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or reliable.

8. Limitation of Liability

To the maximum extent permitted by law, AdVizion shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for direct damages is limited to the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

We may terminate or suspend your access to the Service at any time if you violate these Terms or if required by law. You may cancel your account at any time from the billing page.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after the updated Terms are posted constitutes acceptance. We will provide reasonable notice of material changes.
